1.1 All orders of goods from Everlasting Castings Ltd are subject to availability and acceptance by us. We will contact you in the event that any goods you have ordered are unavailable. You will have the option either to wait until the goods in question are available from stock or to cancel your order.

1.2 In the event that we are unable to supply the goods you have ordered and you have therefore decided to cancel the order we will reimburse your payment in full.

1.3 We currently accept the following payment methods for orders: by debit/credit card on-line or by telephone (our payment service provider is WorldPay. We can also accept payment by PayPal.

1.4 If you wish to order goods from us, you may do so by clicking the "Add to Cart " button beneath each product found on each shopping page of the website. The shopping pages and the products they contain are accessible via the home page. This process applies for paying by debit or credit card only and enables you to buy more than one item via a shopping cart system. You may view the items in your shopping cart via the "View Cart" button on the menu. You may pay for the items in your shopping cart by clicking the "Make payment" button on the shopping cart page. 1.4.1 If you choose to pay by debit/credit card on-line, our payment service provider will ask you for your card details and process your payment. You can choose to cancel your order at anytime until the payment is processed by them by pressing the cancel button.

1.4.2 If you choose to pay by Paypal you will be instructed on where to send your payment.

1.4.3 If you choose to pay by debit/credit card by phone, you may call us on (for UK residents) 0207 482 5552 or (for non-UK residents) +44 (0)207 482 5552.

1.5 Once you have paid for your goods you will receive an email to confirm your order and our intention to process your order and post the goods to you. This email will also act as a receipt for your purchase.

1.6 Once we have received your payment, it is at this point at which a legally binding contract exists between us. The Terms & Conditions are accessible via the footer at the bottom of each page of the Website and we assume you agree to be bound by these at this point.

1.7 Orders cannot be accepted from customers under the age of eighteen (18) years.

2.1 All prices of goods quoted on the Website are inclusive of VAT and exclusive of postage.

2.2 We reserve the right to change our prices for goods and postage at anytime.

2.3 When you have contacted us to place an order of goods, the prices quoted will remain as agreed for a period of not more than 7 days from the time of first contact regarding the order or until we have received payment from you unless we have indicated to you via email otherwise.

2.4 If you contact us as an enquiry and if we quote to you a price for goods or postage, these prices will remain for a period of not more than 7 days from the date of the quote.

3.1 We have a business agreement with Royal Mail and Fedex and our rates are based on these agreements.

3.2 Incorrect delivery details may lead to delays in the delivery of your goods, so before placing your order, please ensure that you have included the full Delivery address details, including accurate postcode of the intended recipient and your daytime contact telephone number in the event that any delivery problems are encountered. If you give us an incorrect address/postcode or missing parts to an address and the parcel goes missing, Everlasting Castings will not be held responsible. We have our sender address on every parcel so a parcel is likely to be returned to us rather than disappear! Please ensure that if the Delivery Address is different to the invoice/registered bank card address that you actually fill in the Delivery address boxes at checkout. There is a note to remind you of this at checkout.

3.3 By signing for your goods delivered via Fedex you are agreeing that they have arrived intact and undamaged. However, if you notify us of any damage by 2pm the next working day we may be able to send a replacement provided we can claim from our courier. We require you to take a picture of the damaged item and email it to us.

4.1 Only goods purchased from Everlasting Castings Ltd may be returned to us.

5.1 Whilst we agree to use our reasonable endeavours to ensure that the Website is fully operational and error-free we cannot guarantee this and therefore accept no responsibility for any defects and/or interruption of the Website and shall be released from our obligations under these Terms and Conditions in the event of any cause beyond our reasonable control which renders the provision of the Website impossible or impractical.

5.2 We exclude, to the fullest extent permitted by applicable laws, and save in respect of death or personal injury arising from our negligence, all liability of any claims, losses, demands and damages arising directly or indirectly out of or in any way connected with the goods supplied by Everlasting Castings or your use or inability to access the Website. This exclusion shall apply in respect of, without limitation, any costs, loss of profits, loss of contracts or business opportunity, loss of data and any other consequential, incidental, special or punitive damages, even if we have been advised of the possibility of such damages, whether arising in contract, tort, under statute or otherwise or due to representations (other than fraudulent or negligent misrepresentations) PROVIDED THAT nothing contained in these Terms and Conditions affects or will affect the statutory rights of the customer or the recipient in relation to the quality, fitness or description of the goods supplied.

6.1 We reserve the right to supplement and amend the Terms and Conditions on which you are permitted access to the Website from time to time. Any changes will be posted on the Website and it is your responsibility as a customer to review any changes on accessing the Website. Changes will be effective one (1) hour after the posting of any such change.

6.2 Additionally, we reserve the right to suspend, restrict or terminate access to the Website for any reason at any time.

6.3 These Terms and Conditions shall be deemed to include all other notices, policies, disclaimers and other terms contained in the Website, provided that in the event of a conflict between any other terms, these Terms and Conditions shall prevail. If any of these Terms and Conditions is held to be invalid or enforceable, the remaining provisions shall remain in full force and effect.

6.4 No waiver by us shall be construed as a waiver of any preceding or succeeding breach of any provision.

6.5 If any part of these Terms and Conditions shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severable from the Terms and Conditions and shall not affect the validity and enforceability of any of the remaining provisions of the Terms and Conditions.

6.6 We shall ensure that we comply with the requirement of all current data protection legislation including, without limitation, the Data Protection Act 1998 (as replaced, modified or re-enacted from time to time). We shall only use personal data received from you for the purpose of fulfilling our obligations under these Terms and Conditions. See our Privacy Policy page for more details

6.7 These Terms and Conditions shall be governed by and construed in accordance with English law and the parties agree to submit to the exclusive jurisdiction of the English courts.

7.1 All Website content including text, picture images, logos, symbols, HTML or any programming code is protected under international copyright law to Everlasting Castings Ltd or our suppliers and service providers.

7.2 Use of any content on the Website outside of its specified purpose will be deemed an infringement of copyright law and will be prosecuted as such.

7.3 Claims ownership without prior agreement with Everlasting Castings Ltd or with intent to falsify identity or steal intellectual property will be deemed an infringement of copyright law and will be prosecuted as such.

8.1 If your impression kit or returned print gets lost in the post this is beyond our control. There will be a £4.50 kit re-issue fee to pay before we can send you another kit. We do not routinely inform you when your print arrives in the post. If you have a deadline it is up to you to check with us that the print has arrived in time for it.

8.2. If you do not follow the instructions in the impression kit and we cannot use your print we will charge £4.50 per kit to send you replacements.

8.3 Each fingerprint jewellery piece is hand-made to your specification. We make a cast from each print and use that to make the impression in the PMC clay. This process is done by hand and as such there will be some variation in size and depth of prints. We allow for a 10% variation in our work. This 10% variation also applies to soldering cufflink backs by hand and lining up writing beneath prints.

8.4 The impression kit material is supplied to us under a special contract. We can allow you to use the impression material to make your fingerprint impression but the ownership of it remains with us. We make a cast from each impression mould and use it to make the jewellery. The cast can be sold on to you or stored so we can make additional jewellery items/replacements in the future. If you do not want us to store your moulds and casts we can destroy them.

8.5 As your order is completely personalised you may return for a refund completed products only if the item is faulty or personalisation details do not match those provided by you. These products are hand made and each one is as individual as the fingerprint it showcases. We can make anything to your requirements however, specific requirements must be made clear on return of your impression kit and consultation will be made with you in the unlikely event your requirements cannot be met. If no specific requirements are given then Everlasting Castings has complete liberty to place the print and/or wording in whatever format, wherever seems most appropriate to Everlasting Castings and you accept that when placing your order. Replacement products for faulty or incorrect items are provided under further consultation between you and us.

8.6. If you decide not to have your jewellery made once you have sent your prints in to us, we will take off £7.50 plus £4.50 per impression kit used from the refund amount.

8.7. Cufflink backs. Our cufflink backs are professionally hand soldered and tested rigorously before being sent out. However, very occasionally a back can break off.

• If one breaks and you contact us within 3 months (28 days is the fit for purpose law so this gives you 3 times as long) then we will refund the return postage, repair it for free & return it to you for free.
• Between 3 – 6 months we will not refund the postage but will repair & return for free.
• After 6 months we will not refund the postage and will charge £12 for the repair plus the return postage.

8.8 Rings. We make the rings to the size you supply. You are responsible for using the simple measuring device sent with your impression kit to measure your finger. We will then create your ring to that size. Finger size also varies throughout life, with weight gain or loss and at different times of day and weather variations. If you measure your size incorrectly we will not be held responsible.
The rings are made of pure silver and as such are softer than sterling silver and liable to thinning or marking through wear. The antiquing on rings may wear off over time depending on wear and exposure to some chemicals. The deeper the print you give us the deeper impression we can make in the silver and the less prone to wear the ring will be. If you wear your ring everyday it may wear more quickly especially if the prints are shallow.

8.9. If you do not return your prints within 1 year and the price of your ordered item has increased, you will need to pay any difference in price in order for us to proceed with your order. This is beacause the price of silver can rise sharply.
